Procédure contentieuse antérieure :
Par une première requête, enregistrée sous le n°1602205, M. M... L..., Mme I... L... et Mme J... G... ont demandé au tribunal administratif de Rennes d'annuler le permis de construire délivré le 11 avril 2016 par le maire de Vitré à M. et Mme D... pour la construction d'une maison d'habitation sur la parcelle cadastrée à la section AX n° 658 à Vitré.
Par une deuxième requête, enregistrée sous le n° 1704059, M. M... L... et Mme I... L... ont demandé au tribunal administratif de Rennes d'annuler le permis de construire délivré le 28 juillet 2017 par le maire de Vitré à M. et Mme D... pour la construction d'une maison d'habitation sur la parcelle cadastrée à la section AX n° 658 à Vitré, ainsi que l'arrêté du 12 juillet 2017 du maire de cette commune procédant au retrait du permis de construire délivré le 11 avril 2016.
Par une troisième requête, enregistrée sous le n° 1804499, M. M... et Mme I... L... ont demandé au tribunal administratif de Rennes d'annuler le permis de construire modificatif délivré le 24 juillet 2018 par le maire de Vitré à M. et Mme D....
Par un jugement n°s 1602205, 1704059, 1804499 du 7 novembre 2019, le tribunal administratif a constaté un non-lieu à statuer sur les conclusions de la requête n°1602205 et rejeté le surplus de leurs demandes.
Procédure devant la cour :
Par une requête, enregistrée le 9 janvier 2020 et un mémoire, enregistré le 29 novembre 2020, qui n'a pas été communiqué, M. M... L... et Mme I... L..., représentés par Me H..., demandent à la cour :
1°) d'annuler le jugement du 18 octobre 2019 du tribunal administratif de Rennes, en tant qu'il a rejeté leur demande tendant à l'annulation du permis de construire délivré le 28 juillet 2017 et du permis de construire modificatif délivré le 25 juillet 2018 ;
2°) d'annuler le permis de construire délivré le 28 juillet 2017 et le permis de construire modificatif délivré le 25 juillet 2018 ;
3°) de mettre à la charge de la commune de Vitré la somme de 3 000 euros au titre de l'article L. 761-1 du code de justice administrative.
Ils soutiennent que :
- le projet méconnaît les dispositions de l'article UE 11 du règlement du plan local d'urbanisme (PLU) de Vitré ; il prévoit la réalisation d'une maison dont le faîtage présentera une orientation est-ouest alors que l'ensemble des constructions environnantes ont une orientation nord-sud ; il crée une densification significative du bâti et est situé à proximité des parcelles qui se trouvent à l'est ; la clôture donnant sur la voie piétonne ne s'harmonise pas avec l'environnement ;
- le permis de construire contesté méconnaît les dispositions de l'article UE 12 du règlement du PLU dès lors que la réalisation du projet supprime la place de stationnement affectée à la construction voisine qui sera transformée en desserte de la parcelle d'assiette du projet ; l'article UE 12 du plan local d'urbanisme exige deux places de stationnement par logement aménagé sur la propriété, de même que le règlement du lotissement reprenant les anciennes dispositions du plan d'occupation des sols ; l'espace situé devant cette parcelle appartient à la voie publique et ne constitue pas une place de stationnement ; le permis modificatif n'a pas pas régularisé le permis délivré le 28 juillet 2017 ; quand bien même la suppression d'une place de stationnement aurait été causée initialement par l'arrêté du 8 décembre 2015 portant division parcellaire, et non par le permis de construire contesté, l'illégalité de cette division emporte l'illégalité du permis de construire contesté ;
- les pétitionnaires n'avaient pas qualité pour déposer la demande de permis modificatif ; dès lors, le permis méconnaît les dispositions de l'article R. 423-1 du code de l'urbanisme en ce qu'il porte sur l'implantation d'un portail sur la parcelle AX n° 657 appartenant à M. et...
