A la demande de Mademoiselle Delphine X... en date du 31 juillet 2008 reçue le 06 août 2008, le Greffe du Conseil de Prud'hommes de SAINT-OMER a, par lettre simple en date du 7 août 2008 et lettre recommandée du même jour ainsi que l'atteste l'avis de réception au dossier, fait citer l'Association ARPAD prise en la personne de son Représentant Légal à comparaître à l'audience du 26 août 2008 devant le Bureau de Conciliation du Conseil de Prud'hommes de SAINT-OMER, Section ACTIVITÉS DIVERSES, pour :
- Calcul de la rémunération sur la base de 151 H 67 mensuelles et non 169 H
- Régularisation depuis la date d'embauche le 05. 08.2002 : 2 963,55 €
- Article 700 du Code de Procédure Civile : 100,00 €
La demanderesse assistée de son conseil a comparu devant le Bureau de Conciliation.
Conformément aux dispositions des articles R. 1454-17, R. 1454-18 et R. 1454-19 du Code du Travail, des délais de communication des pièces et conclusions ont été fixés au 09 / 09 / 08 pour la partie demanderesse et au 23 / 09 / 08 pour l'association défenderesse, qui furent régulièrement convoquées à l'audience du bureau de jugement du 03 octobre 2008.
Après deux remises, l'affaire fut fixée péremptoirement au rôle de l'audience publique du 16 décembre 2008.
Sur quoi, l'affaire fut mise en délibéré pour le Jugement être prononcé par sa mise à disposition au Greffe le 29 décembre 2008.
JUGEMENT :
le 29 décembre 2008, le Conseil de Prud'hommes de SAINT-OMER, Section ACTIVITÉS DIVERSES, après en avoir délibéré conformément à la Loi, a rendu le Jugement suivant :
