Attendu que Pierre et Joséphine X... sont décédés respectivement les 2 juin 1987 et 21 mars 1999, en laissant pour leur succéder leur neuf enfants ; que des difficultés se sont élevées entre les héritiers quant au règlement des successions ;
Sur les deux premiers moyens et sur le troisième moyen, pris en ses deux premières branches :
Attendu que les griefs de ces moyens ne sont pas de nature à permettre l'admission du pourvoi ;
Mais sur la troisième branche du troisième moyen :
Vu l'article L. 321-13 du code rural ;
Attendu que le descendant d'un exploitant agricole qui a participé partiellement à l'exploitation ne peut bénéficier que d'une créance de salaire différé partielle ;
Attendu que la cour d'appel a décidé que le montant de la créance de salaire différé dont Mme Noellie X..., épouse Y... bénéficie, envers la succession de son père, pour la période comprise entre la date de son dix-huitième anniversaire et la date de la célébration de son mariage, sera calculé par le notaire liquidateur sur la base du SMIC en vigueur à la date du partage ;
Qu'en statuant ainsi, après avoir relevé que Mme Y... n'avait exercé qu'une activité partielle sur l'exploitation de son père, la cour d'appel, qui n'a pas tiré les conséquences légales de ses constatations, a violé le texte susvisé ;
PAR CES MOTIFS :
CASSE ET ANNULE, mais seulement en ce qu'il a dit que le montant de la créance de salaire différé dont Mme Noellie X..., épouse Y... bénéficie, envers la succession de son père, pour la période comprise entre la date de son dix-huitième anniversaire et la date de la célébration de son mariage, sera calculé par le notaire liquidateur sur la base du SMIC en vigueur à la date du partage, l'arrêt rendu le 7 janvier 2008, entre les parties, par la cour d'appel de Pau ; remet, en conséquence, sur ce point, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la cour d'appel de Bordeaux ;
Laisse à chaque partie la charge de ses propres dépens ;
Vu l'article 700 du code de procédure civile, rejette la demande de M. X... ;
Dit que sur les diligences du procureur général près la Cour de cassation, le présent arrêt sera transmis pour être transcrit en marge ou à la suite de l'arrêt partiellement cassé ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé par le président en son audience publique du huit juillet deux mille neuf.

Il est fait grief à l'arrêt attaqué d'AVOIR débouté Monsieur Casimir X... de ses demandes d'annulation partielle de la donation du 20 mars 1990 et d'intégration dans la masse des biens existants des parcelles sises à GAN (64), cadastrées Section AT 75, AT 81 et AT 88 du cadastre rénové de GAN incluses dans l'acte de donation du 20 mars 1990 et des parcelles anciennement cadastrées F. 478 p, F. 479 p, 112 p (sans autre précision) et F. 491 ;
AUX MOTIFS QUE, sur la détermination de l'actif immobilier existant, M. Casimir X... et Mme Laurence Z... sollicitent de ce chef, ensemble ou séparément, la réintégration dans l'actif immobilier existant...
