Vu, enregistré au secrétariat le 21 novembre 1988, l'arrêté par lequel, le 12 septembre 1988, le délégué du gouvernement pour la Nouvelle-Calédonie et les Iles Wallis et Futuna, Haut-Commissaire de la République en Nouvelle-Calédonie a élevé le conflit dans la cause opposant devant le tribunal de première instance de Nouméa M. P. S. à la commune de Thio et à l'Etat ;
Vu la requête introductive d'instance le 28 avril 1986 par laquelle M. S. a saisi le tribunal de première instance de Nouméa d'une demande en condamnation de la commune de Thio en paiement d'une indemnité de 64 070 000 F et intérêts pour réparation des dommages consécutifs à des manifestations collectives et actions concertées menées à force ouverte dans la commune de Thio, à partir du mois de novembre 1984 ;
Vu la loi des 16-24 août 1790 et le décret du 16 fructidor an III ;
Vu la loi du 24 mai 1872 ;
Vu l'ordonnance du 1er juin 1828, modifiée par les décrets du 5 décembre 1952 et du 25 juillet 1960 ;
Vu le décret du 26 octobre 1849, modifié par le décret du 25 juillet 1960 ;
Après avoir entendu le rapport de M. Didier, membre du tribunal et les conclusions de Mlle Laroque, Maître des Requêtes, Commissaire du Gouvernement ;
Considérant que l'article 27-III de la loi n° 86-29 du 9 janvier 1986 énonce : "les dispositions de l'article 92 de la loi n° 83-8 du 7 janvier 1983 et celles du présent article (I et II) sont applicables dans les territoires d'outre-mer" ; que l'article 92 de la loi n° 83-8 du 7 janvier 1983 dispose : "l'Etat est civilement responsable des dégâts et dommages résultant des crimes et délits commis à force ouverte ou par violence par des attroupements ou rassemblements armés ou non armés, soit contre les personnes, soit contre les biens" ; que l'article 27 (I et II) de la loi n° 86-29 du 9 janvier 1986 dispose : "I - les...
