Vu, enregistrée à son secrétariat le 27 octobre 2003, la lettre par laquelle le garde des sceaux, ministre de la justice, a transmis au Tribunal le dossier de la procédure opposant M. X et la SOCIETE BRISTOL MYERS SQUIBB au ministre de l'intérieur devant la cour d'appel de Paris ;
Vu le déclinatoire de compétence, présenté le 22 décembre 2002, tendant à voir déclarer la juridiction judiciaire incompétente par les motifs que la mesure de retrait de points affectés au permis de conduire de M. X, prise en application des articles L. 223-1, alinéas 2 et 3, et R. 223-1 du code de la route, ne peut être constitutive d'une voie de fait dès lors qu'elle n'est pas manifestement insusceptible de se rattacher à un pouvoir de l'administration ; que la juridiction administrative est donc compétente pour connaître du litige ;
Vu l'arrêt du 25 avril 2003 par lequel la cour d'appel de Paris a rejeté le déclinatoire de compétence ;
Vu l'arrêté du 16 mai 2003 par lequel le préfet de police a élevé le conflit ;
Vu l'arrêt du 10 octobre 2003 par lequel la cour d'appel de Paris a sursis à toute procédure ;
Vu, enregistré le 7 janvier 2004, le mémoire présenté pour le ministre de l'intérieur tendant à la confirmation de l'arrêté de conflit par les motifs que le paiement de l'amende minorée à la suite des avis de contraventions adressés à la SOCIETE BMS, lesquels mentionnaient les informations relatives aux conséquences du paiement de l'amende, valait reconnaissance des infractions et autorisait l'administration à mettre en oeuvre la réduction des points du permis de conduire ; qu'aucune irrégularité ne peut être reprochée aux services de police et que c'est à tort que le juge judiciaire a retenu sa compétence sur le fondement de la voie de fait ;
