Le Conseil constitutionnel a été saisi le 18 janvier 2011 par le Premier ministre, dans les conditions prévues par le second alinéa de l'article 37 de la Constitution, d'une demande tendant à ce qu'il se prononce sur la nature juridique des mots : « qui doivent être au minimum de 3 520 heures » figurant au premier alinéa de l'article 75 de la loi n° 2002-303 du 4 mars 2002 relative aux droits des malades et à la qualité du système de santé.
LE CONSEIL CONSTITUTIONNEL,
Vu la Constitution, notamment ses articles 34 et 37 ;
Vu l'ordonnance n° 58-1067 du 7 novembre 1958 modifiée portant loi organique sur le Conseil constitutionnel, notamment ses articles 24, 25 et 26 ;
Vu la loi n° 2002-303 du 4 mars 2002 modifiée relative aux droits des malades et à la qualité du système de santé ;
Le rapporteur ayant été entendu ;

Considérant que les dispositions soumises à l'examen du Conseil constitutionnel ont pour objet de fixer la durée de formation conduisant à la délivrance des diplômes d'ostéopathe et de chiropracteur ; qu'elles ne mettent en cause ni les principes fondamentaux de l'enseignement qui relèvent de la loi en vertu de l'article 34 de la Constitution ni aucun des autres principes ou règles placés par la Constitution dans le domaine de...
