FAITS ET PROCEDURE
Par ordonnance en date du 23 juin 2004, le juge des Libertés et de la détention du tribunal de grande instance de VERSAILLES a autorisé les opérations de visite et saisies sur le fondement de l'article L. 450-4 du Code de commerce dans les locaux de différentes entreprises dont ceux de la société COLAS RAIL (anciennement SECO-RAIL) à LYON et à CHATOU.
Des visites et saisies ont été diligentées le 6 juillet 2004 dans les locaux de cette société.
Des pourvois ont été formés contre ladite ordonnance et rejetés par deux arrêts de la Cour de cassation en date du 3 novembre 2005.
Le Conseil de la concurrence a été saisi le 27 mai 2005 par le ministre chargé de l'économie, et la société COLAS RAIL a reçu le 17 avril 2008 une notification de griefs " relative à des pratiques anticoncurrencielles d'entreprises spécialisées dans les travaux de voies ferrées ".
En réplique, elle a notamment fait valoir qu'en l'absence d'un recours effectif au sens de l'article 6 § 1 de la Convention européenne de sauvegarde des droits de l'homme contre l'ordonnance d'autorisation du juge des Libertés et de la détention du tribunal de céans en date du 23 juin 2004, l'ensemble des pièces saisies qui lui étaient opposées devaient être écartées du dossier.
Selon rapport reçu le 19 janvier 2009, il n'a pas été fait droit à sa demande au motif que :
- la solution dégagée par la Cour européenne des droit de l'homme en matière fiscale ne pouvait pas s'appliquer en matière de concurrence ;
- le pourvoi en cassation contre l'ordonnance d'autorisation du juge des Libertés et de la détention ne contrevient pas au principe du droit au recours juridiquement efficace prévu par l'article 6 de la Convention européenne de sauvegarde des droits de l'homme ;
- le recours formé par les parties contre l'ordonnance du juge des Libertés et de la détention du 23 juin 2004 a été rejeté par un arrêt de la Cour de cassation du 3 novembre 2005 ;
- l'article 5 de l'ordonnace n° 2008-1161 du 13 novembre 2008 permet aux sociétés qui l'estiment utile de former un recours contre l'ordonnance du juge des Libertés et de la détention dans le cadre d'un recours sur le fondement de l'article L. 464-8 du Code de commerce.
Considérant que cette argumentation méconnaissait les exigences de l'article 6 § 1 de la Convention européenne de sauvegarde des droits de l'homme, la société COLAS RAIL a par assignation délivrée le 25 mars 2009, attrait Monsieur le ministre chargé de l'économie représenté par le directeur général de la DGCCRF, à l'effet au visa des articles 496 et 497 de voir retracter l'ordonnance du juge des Libertés et de la détention du tribunal de grande instance de VERSAILLES en date du 26 juin 2004 ayant autorisé les visites et saisies sur le fondement de l'article L. 450-4 du Code de commerce dans ses locaux.
